Consumer claims

Consumers have a range of rights when it comes to goods and services. If you have been failed by a provider, you are generally advised to follow their complaints and dispute resolution procedure first. If the matter is not dealt with adequately, we can advise you on making a legal claim but also other routes available to you, including referrals to an Ombudsman

We will endeavour to resolve the matter by way of correspondence and negotiation. It is often the case that a formal solicitor’s letter can spur a company to address a problem promptly and offer a satisfactory settlement. If not, we can discuss further options as to how best to proceed.

Contractual disputes

Contracts govern many aspects of our lives and there is wide scope for disagreement and dispute when one party does not adhere to the agreed terms or there is a misunderstanding as to what the contract is specifying.

Landlord & tenant disputes

Disputes between landlords and tenants can be complex and damaging to both parties if not addressed promptly. We have a wealth of knowledge in the area of Property Law and regularly advise clients in respect of both residential and commercial property disputes. Commercial leases tend to be onerous and disagreements are common when one party breaches the terms or believes the clauses to be unfair. We can intervene early on your behalf to try and find an acceptable solution before a situation escalates. We advise on all aspects of commercial property disputes, including dilapidation claims.

Residential property disputes can be complex, expensive and exhausting for the parties involved. We have a wealth of experience dealing with matters relating to these issues, including residential possession proceedings and advice in matters relating to Section 8 and Section 21 Notices.

Mediation

We always aim to deal with a dispute in the quickest and most cost-effective way possible. If your case cannot be resolved by way of correspondence and negotiation, we can represent you in mediation.

Mediation is a method of alternative dispute resolution. A neutral mediator will work with you both to explain your options and try to help you find common ground. You can agree to settle your case during mediation, but unlike court you will not have an outcome imposed on you. This means that you can be sure that any solution you reach will be one that is acceptable to you.

Medical/clinical negligence

If you have had medical treatment that fell below the standard that could reasonably be expected of a medical professional and you suffered harm or a worsening of your condition as a result, you may be entitled to make a claim for compensation.

This includes in cases of misdiagnosis, late diagnosis, negligence during surgery, incorrect treatment, birth injuries and errors in prescribing medication.

Shared or jointly owned property

When a property is shared, disputes can arise when those involved disagree over ownership or when one party wants the other to move out or to sell the property.

If you have lived in a property with someone and you were not an owner, but you made financial contributions, for example, paying towards the mortgage or for renovation work, you may be entitled to a share of the property, even if your name is not on the title deeds. This is because of the provisions of the Trusts of Land and Appointment of Trustees Act 1996, or TOLATA, which can allow someone to establish a beneficial interest in property, despite not being named as a legal owner.

This is a complex area of law and our property and contentious probate lawyers have a high level of expertise in dealing with TOLATA claims. We can advise you of your rights and discuss the best way of enforcing them.

When two or more individuals or entities enter into a partnership to conduct business, sometimes disputes can arise further down the line. Examples of partnership disputes include concerns over a partner’s performance in their role, conflict relating to profit distribution, or a lack of understanding as to whether assets are owned by the partnership or the individual partners.
